Legal Notice

This document constitutes a legally binding agreement between you and UmmahHost. By using our services, you acknowledge that you have read, understood, and agree to be bound by all terms and conditions outlined herein.

1. Definitions & Interpretation

In this Agreement, unless the context otherwise requires, the following terms shall have the meanings set out below:

  • "We", "Us", "Our" refers to UmmahHost or any party acting on UmmahHost's explicit instructions.
  • "You", "Your", "Client", "Customer" includes the person purchasing the services and/or any party acting on the customer's instructions.
  • "Member" includes the purchaser of services and/or any party acting on the purchaser's instructions.
  • "Registrant" includes the person applying for a domain name or any party acting on the Registrant's instructions.
  • "Registry" refers to the relevant domain names Registry governing the specific top-level domain.
  • "Server" means the computer server equipment operated by UmmahHost in connection with the provision of the Services.
  • "Website" means the area on the Server allocated by us to you for use by you as a site on the Internet.
  • "TOS" includes this entire Terms of Service agreement and all incorporated policies.

UmmahHost reserves the right to modify this policy at any time, effective immediately upon posting of the modification to this URL: https://www.ummahhost.com/terms-of-service/. In consideration of the mutual covenants herein, the parties agree to the following, which shall apply during the term of this agreement. By using any portion of UmmahHost's service, you are agreeing to this service agreement in its entirety.

2. Service Contract & Delivery

This document represents the complete and exclusive statement of the agreement between You and UmmahHost regarding your use of our services.

Immediately upon successful payment completion, you will receive an automated receipt from our billing system. Please print and retain a copy of this receipt and keep it in a safe place for future reference. Your unique customer username will be displayed on this receipt and should be used for all inquiries and communications with UmmahHost.

We aim to deliver all services immediately upon successful signup completion. If we are unable to adhere to this delivery timeline for any reason, you will be informed via email or telephone or both communication methods. Payment will be processed and deducted at the time of service delivery.

All orders are delivered electronically via email to the address provided during registration. If you have any questions about your order status or delivery, please contact us at support@ummahhost.com.

Our customer support operates 365 days per year, 24 hours per day, 7 days per week. We typically respond to inquiries within 1 hour of receiving your message during normal business hours. The services available on our website may be subject to both export and import restrictions in various jurisdictions. It is your responsibility to check regulations in your country to ensure these products and services are allowed for import and use.

3. Refund Policy

If you are dissatisfied with any aspect of our service, please contact our support department first, who will make reasonable efforts to rectify the situation. If the problem cannot be resolved to your satisfaction and you remain unhappy with the service, you are entitled to a full refund within 30 days of the original purchase date. No refunds will be provided after the 30-day period has elapsed.

The following products and services are explicitly excluded from our money-back guarantee and are non-refundable under any circumstances:

  • • Domain name registrations, renewals, and transfers for any TLD including .COM, .NET, .ORG and all other domain extensions
  • • SSL certificates of any type or validation level
  • • Domain transfer-in fees and domain transfer-out fees
  • • Virtual Private Server (VPS) hosting plans
  • • Dedicated server hosting plans
  • • Any products or services provided by UmmahHost through third-party companies or partners
  • • Setup fees and installation charges
  • • Accounts purchased under any promotion, with or without a promotional code

No refunds will be issued if we terminate your hosting or other services due to violation of our Acceptable Use Policy or any other violation of these Terms and Conditions. This policy does not affect your statutory rights as a consumer.

Credit balances on your account cannot be refunded as cash and must be used for future purchases and renewals. Any funds sent to UmmahHost that exceed the amount owed can only be reimbursed as account credit and cannot be refunded to the original payment method.

4. Service Level Agreement (SLA)

UmmahHost guarantees 99.9% network uptime for shared hosting and cloud hosting services. If your service experiences uptime below 99.9% in any given calendar month, you will be credited with one free month of service upon request. This credit must be claimed within 7 days of our monitoring systems detecting the service level drop below the guaranteed threshold.

Any planned maintenance work, whether announced or emergency, is excluded from this uptime guarantee and will not be counted against the 99.9% calculation. Uptime levels are calculated exclusively by our status page monitoring systems and internal monitoring tools. Dedicated servers currently do not have a formal SLA, though we strive to maintain the highest possible uptime for all services.

5. Free Domain Registration Terms

A free domain name will be registered on your behalf when you purchase an annual premium hosting package. Only one domain will be registered free of charge per customer account, regardless of the number of hosting packages purchased.

The free domain registration requires a minimum hosting term commitment of 3 months. After this initial 3-month paid period, you are free to transfer the domain to another hosting provider should you wish to do so. During this 3-month period, the domain may not be transferred to another client or account holder.

If you cancel your hosting service before completing the 3-month paid period, UmmahHost reserves the right to cancel the domain registration or resell the domain name at our discretion.

6. Web Hosting Terms & Policies

These Terms of Service and Acceptable Use Policies constitute an essential part of your relationship with UmmahHost. By using your UmmahHost account, you agree to all terms and policies set out in this document.

The Service is provided to authorized persons or organizations (referred to as "Subscriber" or "you"). Any use of the service is subject to all restrictions listed herein. By using the Service, you agree to be bound by all these Terms and Policies. If you do not agree to be bound by these Terms and Policies, you must cancel your account immediately and may not thereafter use or attempt to use the Service.

Coverage: If you are an individual Subscriber, these Terms and Policies apply to all persons who gain access to our services through your account. If you are a commercial Subscriber, these Terms and Policies apply to all your employees, agents, and/or customers. In either instance, a violation of these Terms and Policies by anyone using your account will be treated as a violation by you.

Prices and Charges: UmmahHost provides the use of cPanel and domain control panels to you free of charge as part of our hosting services. However, if through misuse or abuse on your part we incur any additional charges from third parties, we reserve the right to pass these charges on to you.

Term: The Service is provided to you for as long as you wish to use it and maintain active payments, however we withhold the right to terminate the service if you use it in a way that violates these terms of use.

Backups: UmmahHost performs daily backups of shared hosting accounts for disaster recovery purposes only. These backups are not guaranteed and are maintained strictly for our own use in case of server failure. UmmahHost strongly recommends that all clients maintain their own backups on personal computers or external storage servers. Clients are solely responsible for their own data integrity and preservation. We charge a $10 one-time fee for backup restoration when requested by clients.

Suspended or Terminated Account Backups: If you require backup retrieval for a suspended account, a $20 one-time fee applies. We retain backups of terminated accounts for a maximum of 14 days only. The restoration fee for terminated accounts is $20 per incident, dependent on backup availability. Please note that we do not provide any guarantee regarding the availability or completeness of backups for terminated accounts.

7. Acceptable Use Policy & Grounds for Suspension/Termination

You agree to comply with these Terms and Policies in their entirety. Any violation of either these Terms and Policies or other rules, regulations, or policies noted above may serve as cause for UmmahHost to suspend or terminate your account immediately, with or without notice. You agree that UmmahHost has the right to suspend or terminate your account upon the first or subsequent occurrence of any of the following activities:

  • • Using the Service in a way that constitutes violation of any applicable statute, law, court order, tariff, regulation, or treaty (including, but not limited to, intellectual property, communications, privacy, criminal, and international law)
  • • Hosting websites dedicated to pornography, adult content, or sexually explicit material
  • • Using the Service in a manner intended to abuse or violate the privacy or property rights of others, including but not limited to sending of unsolicited bulk e-mail ("spamming"). This ground for suspension or termination is separate from and in addition to the fees which will result from such activity. You agree to pay a clean-up fee of $50 per hour if any of our server IP addresses appear on a blacklist as a result of spam originating from your account
  • • Using your hosting account primarily as a file or image hosting service rather than for hosting a functional website
  • • Using the Service in an attempt to break security, or so as to actually break security of any computer network (including the Service itself), or to access an account, message, or file which does not belong to you
  • • Using your account as a remote backup service. All files must be part of your active website and must be linked to from your account. Dedicated server clients are exempt from this restriction
  • • Using the Service in such a way as to forge or misrepresent headers, addresses, or other identification in electronic mail or websites, or using any other method to disguise the sender's identity or location. This includes the hosting of Proxy Server applications
  • • Uploading, linking to, or storing warez, cracks, or other pirated software
  • • Assisting in or directly distributing copyrighted material without appropriate authorization
  • • Excessively using the Service in such a way as to limit the bandwidth available to others or degrade overall service performance
  • • Providing fake, incomplete, or inaccurate contact details, including name, postal address, and telephone number
  • • Using the Service to operate server programs, including, but not limited to mail servers, IRC servers, game servers, FTP servers, Web servers, or streaming audio/video servers, unless explicitly permitted by your hosting plan
  • • Using the Service for unauthorized relays through any third party systems
  • • Attempting, in any way, to interfere with or deny service to any user or any host on the Internet
  • • Performing a chargeback on any transactions past or present will result in account suspension until resolved. If a chargeback is issued, we reserve the right to remove your account and deny any future business
  • • Using the Service for mail bombing, which includes any instance where multiple messages are sent to a specific destination with the intent to render the recipient and/or the electronic system serving that recipient dysfunctional

8. Cancellation Policy

Cancellation requests must be submitted exclusively through the client area of our website. To initiate cancellation, navigate to the Services section, click the management icon next to the package you wish to cancel, then select 'Request Cancellation'. You must then complete and submit the cancellation form with the appropriate details.

Selecting immediate cancellation means your service will be terminated within 24 hours of submitting the cancellation request. It is your responsibility to ensure any PayPal subscriptions or other automatic payment methods you have configured are cancelled separately through the respective payment platform.

No other forms of cancellation (email, telephone, support ticket, etc.) are accepted or processed. Cancellation requests must be submitted before the invoice for that billing cycle becomes due. Failure to submit cancellation before the due date will result in the invoice remaining due and payable.

Cancellation requests can only be submitted if the account has no overdue invoices or outstanding balances. For dedicated server cancellations, requests must be submitted a minimum of 15 days prior to the renewal date. Failure to provide sufficient notice may result in charges for the next billing period.

9. Amendments & Contact Information

These Terms and Policies may be amended in any respect at any time by UmmahHost upon the posting of the amended Terms and Policies in the terms of service section of our website. Your continued use of the Service following such amendments will be deemed as consent to any such amended Terms and Policies. If you do not wish to continue to use the Service as a result of any such amended Terms and Policies, you may provide notice of your wish to terminate your use of the Service to UmmahHost.
